A U.S. District Court in Louisiana has granted a temporary restraining order blocking the Biden administration from lifting Title 42. President Trump’s administration activated the public health order at the start of the pandemic to allow the federal government to quickly expel immigrants and asylum seekers.
The lawsuit was originally filed by Missouri, Louisiana, and Arizona.
In a summary of the hearing on the order, the judge said, “For the reasons stated on the record, the Court announced its intent to grant the motion. The parties will confer regarding the specific terms to be contained in the Temporary Restraining Order and attempt to reach agreement.”
Ahead of today’s action, Missouri Attorney General Eric Schmidt said, “It’s just really important for our national security, for our border security; it’s one of the few things the federal government is actually supposed to do—securing the border—and [President] Joe Biden is not interested in that, so under our system of federalism, the states are going to push back.”
President Biden’s administration had planned to lift the order on May 23, and officials anticipate a surge of immigrants to follow.
